A decision made by the United States Court for the Eastern District of Virginia on Jan. 9 gives hope that Rick Perry and other Republican presidential candidates will be able to have their names on the Virginia Republican primary ballot.
The court held a conference call in advance of the hearing date set for January 13 on the question of whether the candidates should be allowed to add their names to the ballot, even though the date for the signing of the required petitions has passed. The suit was brought against the Virginia State Board of Elections by Rick Perry, who wants to be included as a candidate for the presidential nomination in Virginia’s Republican primary. He was joined by Newt Gingrich, Jon Huntsman, and Rick Santorum. If they lose, Virginians will not be able to vote for them in the primary.
Perry and the other candidates claim that it is an unconstitutional violation of free speech for the people who circulate the petitions to put names on the ballot to be Virginia residents.
The court ordered the State Board of Elections to direct the local boards of elections to refrain from sending out absentee ballots until the hearing of January 13 is held, so that, if Perry and the others are added to the ballot, their names can appear on the absentee ballots.
One of the considerations in granting Perry and the other petitioners relief, the court noted that they are likely to succeed on the merits of the case, which gives some indication of how the court may decide regarding the issue at the January 13th hearing when a final decision will be made regarding the constitutional matter.
Meanwhile, the State Board of Elections intends to appeal the interim order.

WASHINGTON -- The U.S. Department of
Homeland Security's Federal Emergency Management Agency announced that federal
disaster aid has been made available to the Commonwealth
of Virginia to supplement commonwealth and local recovery efforts in the area
affected by the Remnants of Tropical Storm Lee during
the period of September 8-9, 2011.
The President's action makes federal funding available to commonwealth and
eligible local governments and certain private nonprofit organizations on a
cost-sharing basis for emergency work and the repair or replacement of
facilities damaged by the Remnants of Tropical Storm Lee in Caroline, Essex, Fairfax, King and Queen, King George, Prince
William, and Westmoreland counties and the independent City of Alexandria.
Federal funding is also available on a cost-sharing basis
for hazard mitigation measures for all counties and independent cities in the
Commonwealth of Virginia.
Donald
L. Keldsen has been named as the Federal
Coordinating Officer for federal recovery operations in the affected area.
Keldsen said additional designations may be
made at a later date if requested by the commonwealth and warranted by the
results of further damage assessments.

These arrests,
pursuant to the 80 plus Grand Jury indictments, are a part of our
continuing efforts to eliminate drug trafficking in Westmoreland
County. I make extensive use of our multi-jurisdictional grand jury
to obtain these “secret” indictments so there is less chance that
the suspects of crime hear about their impending arrest. This helps
keep the citizens, suspects and law enforcement out of extremely
dangerous situations.
The continued
cooperation of local, state and federal law enforcement agencies is
an important tool in the combined effort to reduce manufacturing,
sale and use of drugs in our community.
I want the message to
be “loud and clear” that if you do drug business in Westmoreland
you will be arrested and prosecuted. Cut the supply and reduce the
demand is my objective to insuring the safety of Westmoreland
citizens.
DEAN JEFFERSON ATKINS
Commonwealth’s Attorney
